Privacy Policy

Effective Date: June 25, 2025

Introduction

Aware Tech Inc. ("Aware," "we," "us," or "our") is committed to protecting your privacy. Our mission is to empower businesses with groundbreaking, privacy-first advertising technology. This Privacy Policy outlines our practices concerning the collection, use, and disclosure of information that we receive through our website (https://awaretech.app/), and in the provision of our advertising technology services (collectively, the "Services").

Please review this Privacy Policy carefully. By using our Services, you agree to the collection and use of information in accordance with this policy.

1. Definitions

  • Personal Data: Any information that relates to an identified or identifiable individual.
  • Usage Data: Data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Cookies: Small files stored on your device (computer or mobile device).
  • Data Controller: The natural or legal person who (alone or jointly with others) determines the purposes and means of the processing of Personal Data.
  • Data Processor: Any natural or legal person who processes the data on behalf of the Data Controller. For much of our AdTech Services, we act as a Data Processor.
  • Data Subject: Any living individual who is the subject of Personal Data.
  • GDPR: The General Data Protection Regulation (EU) 2016/679.
  • CCPA: The California Consumer Privacy Act.

2. Information We Collect and How We Use It

A. Information You Provide to Us

When you interact with our website (e.g., request a demo, contact us), we may collect Personal Data, including:

  • Name
  • Email address
  • Phone number
  • Company name and job title
  • Any other information you voluntarily provide.

Use: We use this information to respond to your inquiries, provide you with information about our Services, and for marketing and communication purposes, based on our legitimate interest to engage with potential clients.

B. Information We Collect Automatically (Usage Data)

When you visit our website, we may collect Usage Data automatically, such as:

  • Internet Protocol (IP) address
  • Browser type and version
  • Pages visited, time and date of visit, and time spent on pages
  • Device identifiers

Use: We use this data, collected via cookies and similar technologies, to operate our website, monitor for security threats, analyze trends, and improve the user experience.

C. Information Processed by Our AdTech Services

Our core Services involve privacy-first semantic targeting, secure identifier masking (pseudonymization), and an ad exchange. When we provide these Services to our clients (e.g., Demand-Side Platforms (DSPs) and Supply-Side Platforms (SSPs)), we act as a Data Processor on their behalf.

  • Semantic Targeting: Our proprietary AI analyzes the content of a webpage (text, metadata) to determine its context for ad placement. This process does not rely on building profiles of individual users or tracking their behavior across different websites. The data processed is contextual and is not Personal Data.
  • Pseudonymization: We process identifiers (like cookie IDs or mobile ad IDs) provided by our clients and replace them with anonymized or pseudonymous identifiers. This "Secure Identifier Masking" technology is designed to break the direct link to an individual's identity, allowing for ad-related functions like frequency capping without tracking the individual. We do not enrich this data with other personal identifiers.

3. Legal Basis for Processing Personal Data Under GDPR

If you are from the European Economic Area (EEA), our legal basis for collecting and using the Personal Data described in this Privacy Policy depends on the data we collect and the specific context. We may process your Personal Data because:

  • We need to perform a contract with you.
  • You have given us permission to do so.
  • The processing is in our legitimate interests and it is not overridden by your rights.
  • To comply with the law.

When we act as a Data Processor for our clients, the client (the Data Controller) is responsible for establishing the legal basis for processing.

4. International Transfer of Your Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ. Our servers are located in the United States.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. We will take all steps reasonably necessary to ensure that your data is treated securely. For transfers from the EEA, we rely on Standard Contractual Clauses as a safeguard for data protection.

5. Data Retention

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

6. Data Security

We have implemented administrative, technical, and physical security measures designed to protect the security of any personal information we process. These measures include encryption, access controls, and secure data storage solutions. However, please also remember that we cannot guarantee that the internet itself is 100% secure.

7. Your Data Protection Rights

A. Your Rights Under GDPR (For EEA Residents)

  • The right to access, update or to delete the information we have on you.
  • The right of rectification.
  • The right to object.
  • The right of restriction.

8. Our Role as a Data Controller and Data Processor

We act as a Data Controller for the Personal Data we collect from you when you interact directly with our website.

For our core AdTech Services, we act as a Data Processor on behalf of our clients. Our clients are the Data Controllers, and our processing of any data through the Services is governed by the agreements we have in place with them.

9. Policy for Children

Our Services are not intended for use by children under the age of 16. We do not knowingly collect personally identifiable information from children under 16.
